TéléchargerDu fait d’une obligation législative imposée par la loi « NOTRe » du 07 août 2015, les compétences Eau et Assainissement sont devenues des compétences obligatoires pour toutes les communautés de communes, à compter du 1er janvier 2020 et les élus ont fait le choix d’anticiper.
Cette loi « NOTRe » vient d’être modifiée par la loi « FERRAND » du 3 août 2018, qui permet aux communes membres des Communautés de Communes, sous conditions, de reporter les transferts au 1er janvier 2026 (dans ce cadre, la dissociation assainissement non collectif/ assainissement collectif est possible).
La loi crée également la compétence « eaux pluviales », qui ne relève plus du bloc « assainissement » (compétence facultative pour les communautés de communes, obligatoires pour les communautés d'agglomération).
Par conséquent, le SIT, les syndicats et les communes autonomes ont décidé de se regrouper dans le futur SET qui aura la compétence en matière d’eau potable (production, distribution et transport ainsi que l’assainissement). Compte tenu des évolutions législatives récentes, le SET sera en mesure de restituer à compter du 1er janvier 2019, les eaux pluviales à ses membres.
Pour répondre à cette obligation et assurer cette compétence, le futur SET a fait le choix de créer deux services : le service Eau et le service d’Assainissement du SET.
Afin de conserver une proximité du service, le futur territoire du SET sera découpé en trois secteurs opérationnels :
Le personnel des anciens services gestionnaires de l’EAU regroupés dans ces services, constituera une équipe pluridisciplinaire fidèle aux valeurs du service public, qui œuvrera au quotidien pour un service de proximité, de qualité et harmonisé.
Cette nouvelle organisation permettra une gestion globale du cycle de l’eau à l’échelle du SET et un développement de stratégie cohérente, avec des moyens mutualisés.
Cette mutualisation permettra d’effectuer les importants travaux nécessaires dans des conditions optimisées :
En matière d’eau potable, d’important enjeux de qualités de l’eau potable et de la protection des ressources existent notamment en termes de pollution aux nitrates et aux pesticides mais aussi parfois en termes d’efficience des services (faible rendement hydraulique du réseau conduisant parfois à rejeter via des fuites autant d’eau au milieu naturel que d’eau consommée pour un service donné)
En matière d’assainissement collectif, un enjeu majeur existe autour de la modernisation et de la réhabilitation des stations d’épurations afin d’améliorer la qualité des rejets et ainsi réduire l’impact sur les milieux récepteurs. Il s’agit d’un enjeux futur essentiel dans le cadre du réchauffement climatique annoncé.
Le SIT passe de 21 communes à 50 collectivités dont :
48 pour l’eau potable
19 pour l’assainissement collectif
Ce qui représente 51 délégués depuis le renouvellement des conseils municipaux en 2020 : 1 délégué titulaire par commune, 2 délégués titulaires pour Tonnerre et autant de délégués suppléants.
